The Oregon Hazardous Substance Possession Fee funds three programs designed to minimize the use and dangers of hazardous substances in Oregon.
The Oregon Community Right to Know and Protection Act (ORS 453.307-414) identifies hazardous substances in Oregon, where they are stored, and the hazards associated with them. Information is then provided to emergency planners, first responders, and the public to protect the citizens of Oregon, their property, and the environment from the risks associated with these substances. The Toxic Use Reduction program encourages pollution prevention through education and technical assistance, reducing the use of toxic chemicals and reducing hazardous waste.
The Orphan Site Clean Up program protects public health and the environment, including surface water, ground water, and municipal drinking water supplies. The Hazardous Substance Possession fee is a major funding source for both programs. How Fees are assessed:
The Fees are assessed base off of the reported Chemical/Substance in the highest Maximum Daily Amount and highest Haz Rank, for each facility. The fee is then calculated using a fee schedule set in OAR 837-090 and can be found here: Fee Schedule
The current hazard rankings set in the fee schedule are as follows:
- (rank 1) Minimally Hazardous
- (rank 2) Generally Hazardous
- (rank 3) Very Hazardous
- (rank 4) Registered Chemical
How to Pay and contact info for questions:
Once you complete your report, you will be able to review the fee statement for the year. Payments are not due at the time your report is submitted. An invoice will be mailed by the Oregon Department of Revenue to the mailing address you provided on your annual report. Invoices are normally mailed around mid-November by Oregon Department of Revenue.
The Oregon State Fire Marshal does not process payments. All payments must be directed to the Oregon Department of Revenue at the address provided on the Payment Voucher. An option to pay online is also provided.
*Do not send a payment until you receive a Payment Voucher from the Oregon Department of Revenue.
